Powers of Attorney

A Power of Attorney is a legal document whereby one person grants another person or persons the authority to make legal and financial decisions on their behalf. A Power of Attorney can be used in several ways – from having another take care of your affairs whilst travelling away to times of extended illness. A Power of Attorney can be General or Specific. 


An Enduring Power of Attorney takes this a step further, whereby the person(s) nominated to manage the affairs may continue to manage the affairs once the person giving the power is found to have diminished mental capacity due to injury or illness. This arrangement can remain in place as long as the donor is still alive. 


There are two ways to go about preparing a Power of Attorney. This can either be drafted to take effect immediately, or to come into effect at a future time. This will depend on the parties involved. In any case, the person granting the Power of Attorney must be capable of understanding the nature of the document they are signing and its effect.

Enduring Guardianship

An Enduring Guardianship differs from an Enduring Power of Attorney. The main difference is that an Enduring Power of Attorney is designed to handle a person’s financial affairs, whereas an Enduring Guardianship handles personal decisions. 


The responsibilities of an Enduring Guardianship entails the person granted to determine a person’s living arrangements, their personal services and leisure activities, and consenting or refusing to medical and dental treatment. Enduring Guardianships can also incorporate care directions, such as ‘Do Not Resuscitate’ orders. Such terms and directions can be included in an Enduring Guardianship.
